Public Comments: Members of the Public who wish to speak should fill out a blue slip and submit it to the City Clerk, comments are limited to 3 minutes. In accordance with State Law, remarks during public comment are to be limited to subjects within the City's jurisdiction. If you are unable to provide comments during meeting, written comments on agenda or non-agenda items or both, may be submitted at an hour prior to the start of the meeting.

CONSENT CALENDAR

All matters listed on the Consent Calendar are considered to be routine and will be approved by one motion.  Reading of text of Ordinances is waived and Ordinances are adopted as second reading, by title only.  There will be no separate discussion of these items unless members of the Council request specific items be removed from the Consent Calendar for separate discussion and action.

Ordinance to Amend and Strengthen Code-Enforcement Provisions of the Municipal Code

• RECOMMENDED ACTIONS:

  Council ADOPTS Ordinance No. 758 to be read by title only and further reading waived, amending Chapter 8.08 of the Indian Wells Municipal Code relating to nuisance abatement and adding Chapter 1.28 of the Indian Wells Municipal Code relating to nuisance-abatement cost-recovery; and
  
  FINDS the action to be exempt from the provisions of the California Environmental Quality Act (“CEQA”) under state CEQA Guidelines section 15378(b)(5).

Amendment to Animal Services Agreement with County of Riverside

• RECOMMENDED ACTIONS:

  Council APPROVES First Amendment to the Animal Services Agreement with the County of Riverside; and
  
  DIRECTS City Manager or their designee to execute any agreement for same; and
  
  FINDS the action exempt from CEQA review under CEQA Guidelines section 15061(b)(3).

Finance Committee Actions for Communication’s Plan

• RECOMMENDED ACTIONS:

  Council RECIEVES and FILES the Finance Committee Recommendations for Content and Funding of Communication Plan enhancements; and

  
  FINDS the action exempt from California Environmental Quality Act (CEQA) review under Guidelines section 15061(b)(3).

Annual League of California Cities Conference Voting Delegate Appointments

• RECOMMENDED ACTIONS:

  Council DESIGNATES Council Member Dana Reed as the Voting Delegate and Mayor Pro Tem Bruce Whitman as the Alternate Voting Delegate for the City of Indian Wells at the 2024 League of California Cities Annual Conference held on October 16-18, in Sacramento; and
  
  FINDS the action exempt from California Environmental Quality Act (CEQA) review under CEQA guidelines section 15061(b)(3).

Recruitment and Interview Schedule for Planning Commission and Coachella Valley Mosquito & Vector Control District

• RECOMMENDED ACTIONS:

  Council APPROVES the recruitment schedule and DESIGNATES Mayor Sanders and Councilmember Griffith to serve as the Ad-Hoc Interview Committee for the Planning Commission and Coachella Valley Mosquito & Vector Control District; and
  
  FINDS the action exempt from California Environmental Quality Act (CEQA) review under CEQA guidelines section 15061(b)(3).

Request for Supplemental Appropriation to Modernize City Hall Security System

• RECOMMENDED ACTIONS:

  Council APPROVES a supplemental appropriation for $100,000 to upgrade the City Hall security system. Improvements include updated security components in City Hall including motion sensors, panic buttons, glass break sensors, and cameras; and
  
  FINDS the project to be categorically exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3).

Grant of Utility Easement to Southern California Edison

• RECOMMENDED ACTIONS:

  Council APPROVES grant of easement to Southern California Edison (“SCE”) for SCE to construct, maintain, operate, and repair any SCE-installed infrastructure located on the Indian Wells Civic Center Campus.

  
  FINDS the project to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3).

City Treasurer’s Report for June 2024

• RECOMMENDED ACTIONS:

  Council RECEIVES and FILES the City Treasurer’s Report for June 2024; and
  
  FINDS the project to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15060. 

H.

PUBLIC HEARINGS

For each of the items listed under PUBLIC HEARING ITEMS, the public will be provided an opportunity to speak. After a staff report is provided, the Mayor will open the public hearing. At that time the applicant will be allowed five (5) minutes to make a presentation on the case. Members of the public will then be allowed three (3) minutes each to speak, unless there are a number of person’s wishing to speak and then the Mayor will allow only two (2) minutes, to accommodate for more persons.

The City Council may ask the speakers questions relative to the case and the testimony provided. The question period will not count against your time limit. After all persons have spoken, the applicant will be allowed three minutes to summarize or rebut any public testimony. The Mayor will then close the public hearing portion of the hearing and deliberate the matter.

Ordinance Amending Chapter 21.32 Relating to Time-Share Provisions of the Municipal Code

• RECOMMENDED ACTIONS:

  Council INTRODUCES and DISCUSSES an ordinance adding Chapter 21.32 “Time-Share Uses” and deleting Section 21.04.090 from Title 21 of the Indian Wells Municipal Code reinforcing the City’s prohibition against time-share uses within the City; and
  
  APPROVES the ordinance to be brought back for second reading and adoption; and
  
  FINDS the action to be exempt from the provisions of the California Environmental Quality Act (“CEQA”) under state CEQA Guidelines sections 15060(c)(2), 15060(c)(3), and 15061(b)(3).

GENERAL BUSINESS

The Mayor will call upon the members of the public to address the Council regarding the agenda item being considered. After the public has provided comment, the item is closed to further comment and brought to the Council for discussion and action.

Implementation of a City Pension Policy

• RECOMMENDED ACTIONS:

  Council DISCUSSES and APPROVES the Implementation of a Pension Policy; and

  
  FINDS the project to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15060.

I.2

Implementation of a General Fund Operating Reserve Policy

• RECOMMENDED ACTIONS:

  Council APPROVES and ADOPTS the Implementation of a General Fund Operating Reserve Policy; and

  
  FINDS the project to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15060.

Council’s Request to Review City’s Hedge Height and Tree Regulations

• RECOMMENDED ACTIONS:

  Council DISCUSSES and provides DIRECTION for reviewing the City’s hedge height and tree regulations.

I.4

Comprehensive Traffic Safety Action Plan

• RECOMMENDED ACTIONS:

  Council APPROVES the Comprehensive Traffic Safety Action Plan and the accompanying Resolution; and
  
  FINDS the project to be exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15061 (b)(c).
